Obtaining Social Security Disability (“SSD”) benefits often depends on whether a claimant has acquired skills from past work that can be used in other jobs. During a hearing, the administrative law judge (“ALJ”) relies on a vocational witness (“VW”) to determine if skills can transfer to other jobs. Legal research regarding transferable skills can narrow the issues for the hearing, and could even lead to an OTR.
We represent a claimant from Miller Place with multiple impairments with past relevant work (“PRW”) as a teacher. Prior to the hearing, we filed a brief with copies of federal court decisions where a VW had testified that a teacher has no transferable skills to sedentary work.
The ALJ found that the opinion of the claimant’s doctor supported limitations to sedentary work. Consequently, with the issue of transferability already established, the medical-vocational or “Grid” rules resulted in a fully favorable decision.
